Products and licenses
Swink sells drum kits, sample packs and licenses to use beats. In every case you buy a right to use, never the copyright: Swink remains the author and owner of the compositions and sounds.
Kit sounds
The sounds delivered in kits and sample packs are royalty-free for use in your own music productions, commercial ones included.
You may not resell, share or redistribute them as sounds, kits or loops, even modified, nor upload them to a sound library or third-party service.
Beat licenses
There are three licenses. The MP3 and WAV licenses are non-exclusive: the same beat may be licensed to other people. The exclusive license removes the beat from the catalogue and reserves it for you.
The stream, video and live show caps of each license are shown when you choose, in the license panel.
Exclusive license terms
Exclusivity covers use, not ownership. Swink keeps the copyright, the publishing share and the right to use the beat for its own promotion.
Non-exclusive licenses granted before the exclusive sale remain valid: they are not cancelled retroactively.
Credit
Every license requires the credit “prod. Swink” in the track title or description, on each platform where it is released.
Prices and payment
Prices are shown in euros. For kits, Gumroad acts as merchant of record: it takes the payment and applies the VAT of the buyer's country.
For beat licenses, payment follows what is agreed by email before the files are delivered.
Delivery
Kits are downloadable immediately after payment, through the link sent by Gumroad. The files for a beat license are sent within [to be completed] of payment being received.
Refunds
Refund terms are set out on the page devoted to them.
Governing law
These terms are governed by French law. In case of a dispute, an amicable solution will be sought before any legal action.
A consumer may use a consumer mediator free of charge, or the European online dispute resolution platform.
